To the fullest extent permitted by applicable Philippine law, ph354 shall not be liable to you for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of the Platform, including without limitation any losses arising from:
ph354's total liability to you in respect of any single event or series of connected events shall not exceed the total amount deposited by you to your ph354 Account in the thirty (30) days preceding the event giving rise to the claim. Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, or any liability that cannot be excluded by applicable Philippine law.
ph354 reserves the right to suspend, restrict, or permanently terminate any Player Account at any time, with or without prior notice, where ph354 reasonably determines that:
Upon Account termination for cause, ph354 may forfeit any Balance remaining in the Account. Upon Account termination for reasons other than breach (such as business closure or regulatory direction), ph354 will process a withdrawal of the Player's available real-money Balance to the Player's verified payment method within thirty (30) business days.
ph354 may revise these Terms at any time in response to changes in applicable law, PAGCOR regulatory requirements, business operations, or Platform features. Revised Terms will be posted on ph354.org with an updated "Last Updated" date. Where revisions are material, ph354 will notify registered Players via the email address on their Account no fewer than seven (7) days before the revised Terms take effect.
If you do not accept revised Terms, you may close your Account and withdraw your available Balance before the effective date of the revision. Continued use of the Platform after the effective date constitutes acceptance of the revised Terms. ph354 recommends that Players review these Terms periodically to remain informed of any changes.
These Terms and any dispute arising out of or in connection with them — including disputes regarding their existence, validity, interpretation, or termination — shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of laws principles.
In the event of a dispute between you and ph354, the parties shall first attempt to resolve the matter through good-faith negotiation. You may contact ph354 via live chat or by email at [email protected] to initiate a dispute resolution process. ph354 will respond to formal dispute notifications within five (5) business days.
If the dispute is not resolved through negotiation within thirty (30) days of the initial notification, either party may refer the matter to arbitration or to the appropriate Philippine courts. The parties irrevocably submit to the exclusive jurisdiction of the courts of Metro Manila, Philippines, for the resolution of any dispute that proceeds to litigation.
Nothing in this Section shall prevent ph354 from seeking emergency injunctive or other equitable relief in any court of competent jurisdiction where necessary to protect its proprietary rights or prevent irreparable harm.
